Terms of Service
Last updated: September 2025
1. Agreement and service
These Terms govern your access to and use of the Spotly mobile application and website provided by Kaspar Padberg.
Spotly lets users discover, save, organize, and share points of interest, including lists, photos, comments, social interactions, maps, and location-based reminders.
2. Accounts
Some features require an account. You may register with email/password, Google Sign-In, or Apple Sign In.
You are responsible for your account credentials, account activity, accurate information, and prompt notice of unauthorized use. You must be at least 13 years old to create an account; users under 18 need parental consent.
3. User content
You retain ownership of content you submit, including descriptions, reviews, photos, comments, lists, and collections.
By submitting content, you grant us a non-exclusive, royalty-free, worldwide license to use, reproduce, modify, adapt, publish, translate, distribute, and display that content in connection with operating and improving Spotly.
- Content must not violate laws, infringe rights, include harmful or misleading material, spam, advertising, or compromise the privacy or safety of others.
- We may review, moderate, and remove content that violates these Terms or is otherwise objectionable.
4. Location and social features
Spotly relies on location services for discovery, navigation, geofencing, visit tracking, and location-based alerts. Disabling location services may limit functionality.
You are responsible for managing privacy settings for public, friends-only, or private content and for interacting respectfully with other users.
5. Prohibited uses
- Do not violate laws, transmit malicious content, attempt unauthorized access, disrupt Spotly, impersonate others, harvest user information, use automated access, or reverse engineer the service.
6. Intellectual property and third-party services
Spotly and its original content, features, and functionality are owned by Kaspar Padberg and protected by applicable intellectual property laws.
Spotly integrates third-party services such as Firebase, Google Maps, and authentication providers. Their own terms and privacy policies apply.
7. Availability, privacy, and account deletion
We strive to maintain service availability but cannot guarantee uninterrupted access.
Your use of Spotly is also governed by the Privacy Policy.
You may delete your account in app settings or by contacting support@heyspotly.com. Account deletion is intended to be permanent and removes account data, content, and social connections subject to limited backup or legal retention periods.
8. Disclaimers, liability, governing law, and contact
Spotly is provided as available. To the extent permitted by law, we disclaim warranties and limit liability for indirect, incidental, special, consequential, or punitive damages.
These Terms are governed by the laws of Germany. If any provision is invalid, the remaining provisions remain in effect.
Questions about these Terms can be sent to support@heyspotly.com or by mail to Kaspar Padberg, Möckernstr. 102, 10963 Berlin, Germany.
