1. Provider and scope
These Terms govern your use of Spotly, provided by Kaspar Padberg, Möckernstr. 102, 10963 Berlin, Germany. They are available on the Spotly website and from the App information settings.
Spotly is a publicly available service for discovering, saving, organizing, and sharing places. Unless stated otherwise, it is currently free to download and use.
Features may be maintained, changed, limited, reset, or discontinued. Availability in a particular App Store storefront, specific features, or continued operation is not guaranteed.
2. Eligibility and accounts
You must be at least 16 years old to create an account. If you cannot legally agree to these Terms on your own, you need permission from a parent or legal guardian.
Provide accurate information, keep your account secure, and notify support@heyspotly.com promptly if you suspect unauthorized access.
3. Visibility and sharing choices
Additional profile details and connection lists start hidden. You can change available visibility and interaction settings in the app. Check the visibility of content before sharing it.
Public content may be visible on the web and through link previews. Friends-only content can be viewed only by eligible users in the app. Recipients may still copy content they are allowed to see, so share only content you are permitted to disclose.
4. Your content and licence to Spotly
You retain the rights you hold in descriptions, tips, photos, comments, lists, profile information, and other content you submit. You confirm that you have all necessary rights and permissions, including image, copyright, privacy, and personality rights.
You grant us a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, technically adapt, transmit, and display your content only as needed to operate, secure, moderate, and improve Spotly and to honour your visibility and sharing choices. This licence ends when the content is deleted, except for protected backups, lawful retention, content already copied by other users, and shared place information that no longer identifies you.
- Do not upload private images or personal data of others without a lawful basis and necessary permission.
- Source-media credits and open licences shown in Spotly remain subject to their stated attribution and licence conditions.
5. Acceptable use
- Do not submit unlawful, infringing, deceptive, discriminatory, threatening, harassing, violent, privacy-invasive, sexual content involving minors, or otherwise harmful content.
- Do not impersonate others, manipulate ratings or engagement, send spam or unauthorized advertising, scrape or harvest personal data, or use bots or automated access without written permission.
- Do not introduce malware, bypass security or access controls, test security without authorization, overload the service, reverse engineer except where mandatory law permits it, or use Spotly in a way that endangers people or systems.
6. Moderation, reports, and account restrictions
Spotly provides reporting and blocking tools. We may review reports and use proportionate automated or manual measures to limit distribution, remove content, restrict features or accounts, or preserve evidence where reasonably necessary to enforce these Terms, protect others, or comply with law.
Where required, we will explain a restriction and available options to challenge it. Reports can be submitted in the app or to support@heyspotly.com. We may act immediately where necessary to address a legal, security, or safety risk.
7. Maps, place information, and safety
Maps and place information, including locations, opening hours, contact details, recommendations, distances, and navigation information, may be incomplete, delayed, or inaccurate. Check important information with the venue or an authoritative source.
Do not rely on Spotly for emergencies, personal safety, traffic rules, accessibility, or turn-by-turn navigation. Keep attention on your surroundings and obey local rules. Location permissions and reminders can be disabled at any time.
8. Spotly rights and third-party services
Spotly software, branding, design, and original editorial content are owned by Kaspar Padberg or licensed to us and are protected by applicable intellectual-property laws. These Terms do not grant you any right to use Spotly trademarks or copy the service outside normal use.
Spotly uses third-party services and data sources. Their terms, licences, and attribution requirements may apply. Details about providers that process personal data are available in the Privacy Policy. We are not responsible for third-party destinations you choose to open.
9. Availability, changes, termination, and deletion
We aim to keep Spotly available but do not guarantee uninterrupted or error-free operation. Features may be maintained, changed, limited, or discontinued. Where legally required, we will provide notice of material changes.
You can stop using Spotly and delete your account in Account settings. We may restrict or terminate an account because of a material or repeated breach, a security risk, a legal requirement, or discontinuation of the service. Where required and unless immediate action is necessary, we will provide notice and available options to respond.
The Privacy Policy explains what deletion removes and what may remain for backups, shared neutral place data, other users, legal claims, or statutory duties.
10. Liability
We are liable without limitation for intent and gross negligence, injury to life, body, or health, fraudulent concealment, an expressly assumed guarantee, and liability under mandatory law such as the German Product Liability Act.
For slight negligence, we are liable only for breach of an essential contractual obligation whose performance is necessary for the contract and on which you may normally rely. In that case, liability is limited to the foreseeable damage typical for this type of agreement. Otherwise, liability for slight negligence is excluded. These limits also apply to our legal representatives and agents.
11. Privacy, governing law, changes, and contact
The Privacy Policy is part of the information about your use of Spotly. German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, mandatory protections of the country where you habitually reside remain unaffected, and statutory venue rules apply.
If a provision is invalid, the remaining provisions remain effective and the statutory rule takes its place. We may update these Terms when the service or law changes. Applicable requirements for notice and consent remain unaffected.
